Terms of Use — Tom Yum

These Terms of Use («Terms») are a binding agreement between you («you», «user») and Echelon Apps Limited («Echelon Apps», «we», «us», «our»), a company incorporated in Hong Kong SAR, governing your use of the Tom Yum mobile application and related services and website at https://echelon-app.com/ (the «App» or «Service»).
By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. The Service
Tom Yum is a platform for discovering, rating, reviewing, and saving tom yum restaurants in Thailand. Restaurant information may be sourced from third-party providers and is offered for informational purposes only.
2. Eligibility
You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to create an account or submit content. By using the App you represent that you meet this requirement and that the information you provide is accurate.
3. Accounts and guest mode
- You may browse as a guest without an account. Some features (writing reviews, saving favorites) require an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- You may delete your account at any time via Profile → Delete account. Deletion removes your account, reviews, review photos, favorites, and reports as described in our Privacy Policy.
4. License to use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes on a device you own or control. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App except where permitted by law.
5. User-generated content
5.1 Your content
You retain ownership of the reviews, ratings, photos, and other content you submit («User Content»).
5.2 License you grant us
By submitting User Content, you grant Echelon Apps a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and distribute that content within the App and Service for the purpose of operating, promoting, and improving the Service. This license ends when you delete the content or your account, except for copies that are already cached or required to be retained by law.
5.3 Your responsibilities
You represent that you own or have the necessary rights to the User Content you submit, and that it does not infringe any third-party rights. You must not submit content that:
- is false, misleading, defamatory, or fraudulent (including fake reviews);
- is unlawful, hateful, harassing, threatening, obscene, or sexually explicit;
- infringes intellectual property, privacy, or publicity rights;
- contains malware, spam, or unsolicited advertising;
- impersonates another person or misrepresents your affiliation.
5.4 Reviews must be genuine
Reviews must reflect a genuine experience. Incentivized, fake, or manipulated reviews are prohibited.
5.5 Moderation
We may, but are not obligated to, review, remove, or restrict User Content that violates these Terms, and may suspend or terminate accounts that do so. Users can report content via the in-app reporting feature.
6. Acceptable use
You agree not to:
- use the App for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorized access to the Service, other users’ accounts, or our systems;
- interfere with or disrupt the Service, or circumvent security or rate limits;
- scrape, harvest, or bulk-extract data from the App;
- use the App to send spam or harass other users.
7. Intellectual property
The App, its design, logos, trademarks, and all software and content (excluding User Content and third-party content) are owned by Echelon Apps or its licensors and are protected by intellectual-property laws. Nothing in these Terms transfers any such rights to you.
8. Third-party services and content
The App integrates third-party services, including Mapbox (maps and geocoding), Google (sign-in and Places data), and Supabase (backend hosting). Restaurant names, addresses, photos, and other details may come from these providers and may be inaccurate, incomplete, or out of date. Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services or content.
9. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED «AS IS» AND «AS AVAILABLE» WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that restaurant information is accurate, that the App will be uninterrupted or error-free, or that defects will be corrected. Any reliance on information in the App is at your own risk.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHELON APPS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Echelon Apps from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the App, or your violation of these Terms or any third-party rights.
12. Suspension and termination
We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitation of liability, governing law) will survive.
13. Changes to the Terms and the Service
We may modify these Terms or the App at any time. Material changes will be communicated in the App or on our website, and the «Last updated» date will be revised. Continued use after changes take effect constitutes acceptance. We may also add, change, or discontinue features without liability.
14. Governing law and disputes
These Terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights in your country of residence, you agree that the courts of Hong Kong have jurisdiction over any dispute arising out of or relating to these Terms or the App.
15. Apple App Store — Additional Terms (EULA)
The following additional terms apply when you obtain the App from the Apple App Store. In the event of a conflict between these terms and the rest of the Terms, these App Store terms govern with respect to your use on Apple devices:
- Acknowledgement. These Terms are concluded between you and Echelon Apps Limited only, and not with Apple. Echelon Apps, not Apple, is solely responsible for the App and its content.
- Scope of license. The license granted for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions and the Usage Rules in the App Store Terms of Service.
- Maintenance and support. Echelon Apps is solely responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
- Warranty. Echelon Apps is solely responsible for any product warranties, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product claims. Echelon Apps, not Apple, is responsible for addressing any claims relating to the App, including (i) product-liability claims, (ii) claims that the App fails to conform to legal or regulatory requirements, and (iii) claims under consumer-protection or similar legislation.
- Intellectual property claims. In the event of any third-party claim that the App or your use of it infringes that third party’s intellectual-property rights, Echelon Apps, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
- Legal compliance. You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated as «terrorist-supporting», and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints, or claims regarding the App should be directed to manager@echelon-app.com.
- Third-party beneficiary. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
16. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Echelon Apps regarding the App.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
